General terms and conditions of Staatsbad Bad Ems GmbH for the online shop.As of: 01/07/2014 

• 1 Field of application

The business relationships between Staatsbad Bad Ems GmbH and the customer are exclusively governed by the following general terms and conditions as amended at the time of ordering. We do not accept any deviating terms of the customer, unless Staatsbad Bad Ems GmbH has given an explicit written consent for this purpose. 

• 2 Conclusion of contract

Your order is an offer to us for concluding a purchase contract. If you place an order at the Staatsbad Bad Ems shop you will receive an email from us with the confirmation of having received the order and indicating its details.A purchase contract is concluded with us when Staatsbad Bad Ems GmbH accepts this offer from the customer. Staatsbad Bad Ems GmbH accepts this offer under reservation of the availability of the ordered goods. A declaration of acceptance by Staatsbad Bad Ems GmbH to the customer is not required.In case of any mistakes in writing, printing or calculating in the Staatsbad Bad Ems GmbH shop, Staatsbad Bad Ems GmbH is entitled to withdraw from the contract. 

• 3 Withdrawal and return

The customer can withdraw from the contract in writing (also by email) or by returning the goods within two weeks after having received the goods. In the event of a withdrawal, Staatsbad Bad Ems GmbH will return to the customer a purchase price that has already been paid. It is pointed out that – if applicable – a depreciation caused by having used the product can be retained. A right of withdrawal does not exist for audio or video recordings (for example CDs, video cassettes, DVDs) or software which have been unsealed by the customer. After expiry of the fourteen day right of withdrawal, the goods can only be returned upon consultation and by charging an administrative charge. This decision is in the responsibility of Staatsbad Bad Ems GmbH.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without indicating any reasons. The withdrawal period is fourteen days starting from the day where you or a third party appointed by you, who is not the carrier, took possession of the goods. In order to exercise your withdrawal right you must inform us, Staatsbad Bad Ems GmbH, Römerstraße 8, D-56130 Bad Ems, Phone +49 (0)2603/9730, Telefax +49 (0)2603/973100, Email: sbbe@staatsbad-badems.de, by means of a clear declaration (for example a letter sent by mail, a telefax or an email) that you decide to withdraw from this contract. For this purpose you can use the enclosed sample withdrawal form which is however not mandatory to be used. For complying with the withdrawal period it is sufficient to send the declaration about exercising your right of withdrawal before expiry of the withdrawal period.Consequences of withdrawalIf you withdraw from this contract, we have to return to you all the payments which we received from you including the delivery costs (with the exception of any additional costs resulting from the fact that you chose a different delivery option from the cheapest standard delivery option offered by us), this return of payment has to be effected without delay and not later than within fourteen days from the day on which we received your information about your withdrawal from this contract. For this repayment we use the same payment method which you had used for the initial transaction unless you have expressly agreed otherwise; we will in no event charge any fees to you because of this repayment. We can refuse to return the payment until we have received the returned goods or you have provided evidence that you returned the goods, whatever occurs earlier.You have to return or hand over the goods without delay and in any case no later than fourteen days after the day on which you informed us about the withdrawal from this contract. The deadline is met if you send the goods before expiry of the period of fourteen days. You bear the direct costs for returning the goods. You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that goes beyond what is necessary to check their quality, characteristics and function.

• 4 Delivery

Staatsbad Bad Ems GmbH delivers the ordered goods to the address indicated in the order. We reserve the right to make partial deliveries. The goods are delivered at the delivery costs indicated in each individual case. 

• 5 Due date of payment and payment, delay

• 6 Retention of title

The delivered goods remain the property of Staatsbad Bad Ems GmbH until payment is made in full.  

• 7 Warranty

The customer commits to inform Staatsbad Bad Ems GmbH immediately in writing in case of any deficiency in the delivered goods. If there is a deficiency in the delivered goods for which Staatsbad Bad Ems GmbH is responsible, they will remedy this deficiency at their option by corrective action or replacement delivery. If the corrective action or the replacement delivery fail and/or if Staatsbad Bad Ems GmbH ist not prepared or not in the position to do so or if there are delays beyond unreasonable time limits for reasons for which Staatsbad Bad Ems GmbH is responsible, the customer is entitled to withdraw from the contract or to demand a reduction of the purchase price. 

• 8 Data protection

Processing of personal data Staatsbad Bad Ems GmbH commits to protect the privacy of all persons who shop at the Staatsbad Bad Ems GmbH shop and to treat personal data confidentially. The basis for this are the respective applicable statutory regulations such as the Federal Data Protection Act (BDSG) and the Law to Regulate the Conditions for Information and Communications Services (IuKDG).

Use of personal dataStaatsbad Bad Ems GmbH uses the customers’ data exclusively for the purpose of fulfilling the contract concluded with the customers. Personal data will not be passed on to any third party.

Safety measures to prevent the loss and misuse of personal dataWhen transferring personal data we use encryption technology to ensure the highest level of confidentiality.

The customers’ personal data are protected by password so that only the customer can access. Our server uses various security mechanisms and authorization processes to make unauthorized access by third parties more difficult. 

• 9 General information requirements acc. to § 36 Consumer Dispute Settlement Act (VSBG)

The organisation Staatsbad Bad Ems GmbH will not participate in a dispute settlement procedure by a consumer arbitration service in the sense of VSBG and is not obliged to do so. 

• 10 Applicable law

German law is applicable excluding the UN-Convention on Contracts for the International Sale of Goods.
